Do Wills and Powers of Attorney Need to Be Notarized?

In Ontario, a will or Power of Attorney does not need to be notarized to be legally valid. Validity depends on how the document is prepared and signed, including proper witnesses and legal requirements set out in Ontario legislation — not on whether a notary public is involved.

However, some courts, banks, financial institutions, and third parties may ask for supporting notarized documents, such as:

  • An affidavit of execution for a will
  • A notarized certified true copy of a signed Power of Attorney

Affidavit of Execution for Wills

An affidavit of execution is a sworn statement, usually signed by one of the witnesses to a will, confirming that:

  • The witness saw the will-maker sign the will (or acknowledge their signature), and
  • The will was signed in accordance with Ontario’s formal requirements.

Courts, probate offices, and some institutions often request an affidavit of execution to help prove that the will was properly signed. At Snap Notary, we:

  • Verify the identity of the witness signing the affidavit
  • Administer the oath or solemn affirmation
  • Notarize the affidavit of execution and apply our notarial seal

Powers of Attorney & Certified Copies

Powers of Attorney for Property and for Personal Care also do not need to be notarized to be valid in Ontario. That said, banks, investment firms, and other organizations may ask for:

  • A certified true copy of the signed Power of Attorney, or
  • Evidence that the document was properly signed and witnessed.
